Bucklew<\/strong><\/a> at the U.S. District Court for the Middle District of Florida, after an investigation I&#8217;d conducted revealed probative evidence that convicted killer and one time Gambino associate John Alite, aka &#8220;Johnny Aletto,&#8221; had repeatedly violated the terms of his Supervised Release.<\/p>\n<p>Judge Bucklew had sentenced Alite on April 26th, 2011 t0 100 months in prison and five years probation. Under the terms of her <a title=\"Attach B\" href=\"http:\/\/peterlance.com\/Attach_B_Bucklew_Alite_sentencing_1_10_12.pdf\"><strong>Amended Order<\/strong> <\/a>Alite was required to get permission from the U.S. Probation Office each time he left his New Jersey district and he was forbidden from associating with members or associates of organized crime &#8212; a boilerplate provision in mob sentences.<\/p>\n<p><a href=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-10.11.42-PM.png\"><img loading=\"lazy\" class=\"alignleft wp-image-7778\" title=\"Screen Shot 2015-10-21 at 10.11.42 PM\" src=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-10.11.42-PM.png\" alt=\"\" width=\"220\" height=\"257\" srcset=\"https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-10.11.42-PM.png 424w, https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-10.11.42-PM-256x300.png 256w\" sizes=\"(max-width: 220px) 100vw, 220px\" \/><\/a>But as I detailed in the letter below Alite repeatedly traveled outside the state of New Jersey to New York and made additional trips to Ohio, Florida, Pennsylania and Delaware, while <a title=\"Anton letter\" href=\"http:\/\/peterlance.com\/D_Anton_to_PL_9_8_15.pdf\"><strong>in a letter to me<\/strong> <\/a>on September 8th his attorney Doug Anton admitted &#8220;we gotta stay in Jersey.&#8221;<\/p>\n<p>More disturbing were pictures found on Alite&#8217;s own Facebook account showing him associating with former wiseguys like James \u201cJimmy Gap\u201d Calandra, an ex-Bonnanno associate who pled guilty to <strong><a title=\"Attach G\" href=\"http:\/\/peterlance.com\/Attach_B_Bucklew_Alite_sentencing_1_10_12.pdf\">t<\/a><a title=\"Attach G\" href=\"http:\/\/www.nytimes.com\/1999\/10\/17\/nyregion\/1991-killing-is-said-to-be-revenge-for-robbery-of-mob-figure-s-daughter.html\">he felony murder<\/a><\/strong> of a 46 year-old Staten Island woman in 1993\u00a0and Pasquale &#8220;Patsy&#8221; Andriano, a former member of Alite&#8217;s crew who confessed his role in the Alite-inspired killing of rival drug dealer John Gebert in 1996.<\/p>\n<p><strong>THE U.S. PROBATION OFFICE INVESTIGATES<\/strong><\/p>\n<p>On September 14th, less than a week after I&#8217;d sent the package to Judge Bucklew, I was contacted by Paul Brennan, The National WITSEC Coordinator in Washington, who <a title=\"Brennan 9.14.15 invest\" href=\"http:\/\/peterlance.com\/P_Brennan_to_PL_9_14_15_email_confirms_investigation.pdf\"><strong>confirmed<\/strong><\/a> that the Newark headquarters of the U.S. Probation Office had mounted an investigation into my findings.<\/p>\n<p>On October 6th Mr. Brennan<a title=\"2nd Brennan email\" href=\"http:\/\/peterlance.com\/P_Brennan_to_PL_10_6_15_report_in_48_hours.pdf\"> <strong>sent word to me <\/strong><\/a>by email<a title=\"Brennan report in 48 hours\" href=\"http:\/\/peterlance.com\/P_Brennan_to_PL_10_6_15_report_in_48-hours.pdf\">\u00a0<\/a>that a report with the probe&#8217;s findings would be forthcoming in 48 hours and two days later he let me know that it had been sent to Tampa for examination by Judge Bucklew and Probation officials there.<\/p>\n<p>Last week, informed sources reported that Mr. Alite had been summoned to a meeting in Tampa with <a title=\"Jay Trezevant\" href=\"https:\/\/www.linkedin.com\/pub\/jay-g-trezevant\/5\/3a3\/944\"><strong>Jay G. Trezevant<\/strong><\/a>, the Assistant U.S. Attorney who used him as the so-called &#8220;star witness&#8221; in the fourth federal prosecution of John A. &#8220;Junior&#8221; Gotti which ended in a mistrial in 2009.<\/p>\n<p>At that time<a title=\"AP story Alite\" href=\"http:\/\/www.huffingtonpost.com\/2009\/12\/01\/gotti-mistrial-junior-got_n_375769.html\"><strong> the AP reported<\/strong> <\/a>that the jury was unanimous that Mr. Alite was the &#8220;least credible&#8221; witness and after that defeat, in throwing in the towel on any further Gotti Jr. prosecution, the Feds never again put John Alite on the stand.<\/p>\n<p><strong>AWAITING JUDGE BUCKLEW&#8217;S CALL<\/strong><\/p>\n<p>It&#8217;s now up to Judge Bucklew, known as a no-nonsense magistrate, to decide whether Alite, an Albanian-American associate who was never &#8220;made&#8221; as a Gambino soldier, did, in fact, violate the terms of her order.<\/p>\n<p>On October 20th I sent her <a title=\"Bucklew 10 20 15\" href=\"http:\/\/peterlance.com\/Judge_Bucklew_10_20_15_with_attachments.pdf\"><strong>a follow-up letter<\/strong> <\/a>after I discovered that in 2002 New Jersey Federal Judge Joseph H. Rodriquez &#8220;violated&#8221; Mr. Alite; sending him back to prison for three months after the ex-Gambino associate broke the terms of his Supervised Release in a New Jersey gun case.<\/p>\n<p>Whatever her disposition I&#8217;ve asked her for a copy of the U.S. Probation Office&#8217;s report so that the public can get some sense of why Federal officials in New Jersey kept the convicted murderer and home invader on such a long leash.<\/p>\n<p><strong>THE SEPTEMBER 8th LETTER<br \/>\nTHAT PROMPTED THE PROBE\u00a0<\/strong><\/p>\n<p>Hon. Gibbons U.S. Courthouse<br \/>\n801 North Florida Avenue<br \/>\nTampa, FL 33602<\/p>\n<p>cc: Jay Trezevant, AUSA MDF Tampa<br \/>\nJoseph Brine (SSA); Jamie Aguirre, FBI Los Angeles<br \/>\nRichard Antonison U.S. Probation Office, Camden NJ<\/p>\n<p>September 8th 2015<br \/>\nFederal Express<\/p>\n<p>Judge Bucklew,<\/p>\n<p>I\u2019m writing to you after having spoken several weeks ago to your extremely able civil clerk Jennifer Deeb and later to your Courtroom Deputy Susan Saylor who confirmed for me that John E. Alite, whom you sentenced to 120 months on April 26<sup>th<\/sup>, 2011 (later reducing the sentence to 100 months with 60 months Supervised Release) is still on Supervised Release.<\/p>\n<p>The reason that question became an issue for me as a journalist is that on April 4<sup>th<\/sup>, Mr. Alite sent me a defamatory and threatening email with the subject matter \u201cJerk off,\u201d<a title=\"Attachment A\" href=\"http:\/\/peterlance.com\/Attach_A_Alite_email_8_4_15.pdf\"><strong> (Attachment A)<\/strong><\/a> after I\u2019d begun researching allegations that he had repeatedly violated the terms of that release <a title=\"Attachment B\" href=\"http:\/\/peterlance.com\/Attach_B_Bucklew_Alite_sentencing_1_10_12.pdf\"><strong>(Attachment B)<\/strong><\/a> by making multiple trips outside of his NJ Judicial District, without first getting the approval of his probation officer and that he had repeatedly met with convicted former organized crime associates including one Pasqual Andriano who had pled guilty to an Alite-related homicide.\u00a0<a href=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Alite-mug-shot.png\"><img loading=\"lazy\" class=\"alignright wp-image-7773\" title=\"Alite mug shot\" src=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Alite-mug-shot.png\" alt=\"\" width=\"239\" height=\"320\" \/><\/a><\/p>\n<p>Further, I learned that in addition to the email to me, while holding himself out as a reformed \u201cmotivational speaker\u201d Mr. Alite had engaged in a broad campaign of cyber-bullying that included threatening a woman in the U.K. who had the temerity to question one of the specious claims he made in <em>Gotti\u2019s Rules<\/em>, a purported memoir of Mr. Alite\u2019s life as a low-level Gambino Family associate which he had been promoting since its publication in January.<\/p>\n<p>Finally, my investigation has led me to conclude that the two AUSA\u2019s who filed 5K1 Motions; resulting in your downward release order for Mr. Alite may have misled you as to the quality and results of his alleged \u201csubstantial assistance.\u201d<\/p>\n<p>Since you are a jurist with a stellar reputation and since my efforts to inform Mr. Alite\u2019s probation office of this evidence seem to have fallen on deaf ears, I\u2019m writing to you in the hope that you will make sure that your Amended Judgment in <span style=\"text-decoration: underline;\">U.S. vs John E. Alite &amp; John Malone <\/span>(8:04-cr-00348-SCB-TGW) is being properly enforced and that Mr. Alite, whom I believe to be a potential time bomb waiting to go off, does no physical harm as he remains on the street subject to that Judgment. He asked me if I would write the Foreword.<\/p>\n<p>Since I\u2019m a journalist and not a gun for hire and since, while something of an expert on The Colombo Crime Family (the subject of\u00a0 <em><strong>Deal With The Devil<\/strong>)<\/em> I knew very little about the Gambinos or his prosecutions, I told Mr. Gotti that I couldn\u2019t commit to associating myself with his memoir until I did the research.<\/p>\n<p>I told him that if he granted me full unfettered access to his files and if I came to believe his assertions that he had long ago left \u201cthe life\u201d and that John Alite had falsely testified against him at his 4<sup>th<\/sup> trial, I would consider writing the Foreword.<\/p>\n<p>It took me half of the fall to finish the research and I did write the Foreword <a title=\"Attachment F\" href=\"http:\/\/peterlance.com\/Attach_F_Shadow_Final_Foreword_1_19_15.pdf\"><strong>(Attachment F)<\/strong><\/a> which I urge you to read. It was published with <em>Shadow <\/em>in mid January just prior to <em>Gotti\u2019s Rules.<\/em> So there were now two vastly different accounts of Mr. Alite\u2019s story in print. \u00a0<a href=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Screen-Shot-2015-10-21-at-8.48.57-PM2.png\"><img loading=\"lazy\" class=\"alignright wp-image-7769\" title=\"Screen Shot 2015-10-21 at 8.48.57 PM\" src=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Screen-Shot-2015-10-21-at-8.48.57-PM2.png\" alt=\"\" width=\"242\" height=\"366\" srcset=\"https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Screen-Shot-2015-10-21-at-8.48.57-PM2.png 415w, https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Screen-Shot-2015-10-21-at-8.48.57-PM2-198x300.png 198w\" sizes=\"(max-width: 242px) 100vw, 242px\" \/><\/a><\/p>\n<p><strong>ALITE\u2019S FALSE CLAIM THAT\u00a0<\/strong><strong>GOTTI JR. WAS A CI<\/strong><\/p>\n<p>At that point in February, 2015 I returned to paying work which included consulting on a local civil case in Santa Barbara. I let whatever battles between Mr. Gotti and Mr. Alite over the two books take their course in the media; although I kept \u201cGoogle Alerts\u201d active for both individuals and occasionally would find interviews with Mr. Alite in which he made some preposterous claims.<\/p>\n<p>Principal among them was that based on an FBI 302 purportedly describing a proffer session by Mr. Gotti on January 18<sup>th<\/sup>, 2005 \u2013 a session that lasted 45 minutes, wasn\u2019t memorialized until a year later and ended in no cooperation deal \u2013 Mr. Gotti had an been an FBI \u201cconfidential informant\u201d for years.<\/p>\n<p>In short, Mr. Alite was putting Gotti Jr. in the same category as the subject of <em>Deal, <\/em>Gregory Scarpa Sr., aka \u201cThe Grim Reaper\u201d and \u201cThe Killing Machine,\u201d a notorious Colombo capo who had \u201cstopped counting\u201d after 50 homicides and who worked as a Top Echelon Criminal Informant (TECI) for the Bureau for more than thirty years, getting paid more than $1 million (in 2013 dollars) and betraying all of the bosses and underbosses above him (with the help of FBI intel) as he rose to the \u201cboss level\u201d of the Colombos.<\/p>\n<p>On my own book tour, appearing multiple times on <a title=\"MSNBC\" href=\"http:\/\/peterlance.com\/wordpress\/?p=2729\"><strong>MSNBC<\/strong><\/a> during the trial of James \u201cWhitey\u201d Bulger, I described Scarpa\u2019s corruption of his FBI contacting agent R. Lindley DeVecchio as \u201cThe Bulger story on steroids.\u201d<\/p>\n<p><strong>GOTTI JR.\u2019S REFUSAL TO COOPERATE<\/strong><\/p>\n<p>But Alite\u2019s false claim, characterizing that 302 memo as conferring \u201cCI\u201d status on Mr. Gotti was typical of his exaggerations; particularly when one considers that John \u201cJunior\u201d endured four (4) separate trials and a 5<sup>th<\/sup> parole tax prosecution as a result of his steadfast refusal to become a government CW. Why? Because the Feds made it clear to him in 2008 that if he became \u201ca rat,\u201d in street parlance and testified against his former Mafia cohorts, then he would be a free man.<\/p>\n<p>That\u2019s the kind of deal that sprung John Alite from an oppressive Brazilian prison and (if you read the Foreword) it\u2019s the same deal that FBI agent Ted Otto offered Joseph O\u2019Kane, a longtime Gambino associate and friend of Mr. Alite\u2019s, if he would only testify as a buttressing witness to Mr. Alite at \u201cGotti IV.\u201d<\/p>\n<p>But in one of the most moving and revealing moments in Mr. Gotti\u2019s fourth trial, Mr. O\u2019Kane refused to give false testimony. He was then shipped back to prison where he was later murdered in his cell.<br \/>\n<strong><br \/>\nCLAIMING HE SERVED 20 YEARS<\/strong><\/p>\n<p>Anyway, because I\u2019d written the Foreword and because I\u2019m always exasperated when fellow journalists allow interview subjects to make false claims without challenging them, I came across a piece in late July by one Theresa Neuhoff, a local reporter in Cleveland who covered Mr. Alite\u2019s appearance at a purported benefit for the Epilepsy Foundation (July 24<sup>th<\/sup>) in which he shared the stage with James \u201cJimmy Gap\u201d Calandra, a former Bonnanno associate who had pled guilty to the felony murder of a 46 year-old Staten Island woman in 1993.<\/p>\n<p>See <em>NYT<\/em> coverage of Mr. Calandra\u2019s indictment <a title=\"Attachment G\" href=\"http:\/\/www.nytimes.com\/1999\/10\/17\/nyregion\/1991-killing-is-said-to-be-revenge-for-robbery-of-mob-figure-s-daughter.html\"><strong>(Attachment G)<\/strong><\/a>. Even though the epilepsy benefit was for a worthy cause, when I saw it advertised, I thought it curious that Mr. Alite would be allowed by the U.S. Office of Probation to travel from NJ to Ohio, and hang our with another Mafia associate who had also been convicted of murder.<\/p>\n<p>But I let it go until I read Ms. Neuhoff\u2019s account of the event <a title=\"Attachment H\" href=\"http:\/\/www.morningjournal.com\/opinion\/20150730\/neuhoff-former-mafia-members-explain-why-the-life-should-not-be-glamorized\"><strong>(Attachment H).<\/strong><\/a><\/p>\n<p>In it she reported that \u201cAlite, who spent 20 years in prison, spoke about committing more than 40 murders.\u201d She also wrote that Mr. Alite \u201calso suffers from epilepsy,\u201d a statement I found curious since that is never mentioned in the 368 pages of <em>Gotti\u2019s Rules<\/em>. I happen to take the subject seriously because I was born with <em>petit mal<\/em> and suffered with it in my childhood. Further, my older cousin has been plagued by <em>grand mal<\/em> seizures his entire life.\u00a0So I emailed Ms. Neuhoff and politely asked her if she had a tape recording or transcript of the event.\u00a0<a href=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.36.12-PM.png\"><img loading=\"lazy\" class=\"alignright wp-image-7810\" title=\"Screen Shot 2015-10-21 at 11.36.12 PM\" src=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.36.12-PM.png\" alt=\"\" width=\"461\" height=\"420\" srcset=\"https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.36.12-PM.png 640w, https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.36.12-PM-300x273.png 300w\" sizes=\"(max-width: 461px) 100vw, 461px\" \/><\/a><\/p>\n<p><strong>UNLEASHING JOHN ALITE\u2019S WRATH<\/strong><\/p>\n<p>Apparently Ms. Neuhoff informed Mr. Alite about my query, because she quickly amended her story from \u201c40 murders\u201d to \u201c40 shootings,\u201d keeping the epilepsy claim intact.\u00a0 When I politely asked her (by email) if Mr. Alite had pressed her for the change, that prompted his August 4<sup>th<\/sup> \u201cJerk off\u201d email. <a title=\"Attachment A\" href=\"http:\/\/peterlance.com\/Attach_A_Alite_email_8_4_15.pdf\"><strong>(Attachment A).<\/strong><\/a><\/p>\n<p>That email in which he made the \u201cheroin addict\u201d claim and falsely suggested that I\u2019d tried \u201cto sleep with reporters from Daily Mail,\u201d (sic) that I was a \u201clap dog,\u201d \u201cboy toy with no pride,\u201d and \u201ca joke,\u201d also contained a revelatory challenge.<\/p>\n<p>In it, Mr. Alite invited me to join him a on Mulberry Street, in New York\u2019s Little Italy, suggesting that he was crossing the Hudson with impunity.<\/p>\n<p><strong>MY CONVERSATION WITH FBI AGENTS<\/strong><\/p>\n<p>Because of the threatening tone of the email, John Alite\u2019s propensity for violence and because I have children who live in the New York area, I left a voice mail for AUSA Jay Trezevant asking him to intervene. I never heard back from him but two days later on August 6<sup>th<\/sup> I got a call from SSA Joseph Brine and SA Jaime Aguirre of the FBI\u2019s Los Angeles Field Office.<\/p>\n<p>After a lengthy conversation with them I sent them a follow-up email <a title=\"Attachment I\" href=\"http:\/\/peterlance.com\/Attach_I_PL_to_FBI_LA_8_6_15.pdf\"><strong>(Attachment I)<\/strong> <\/a>stating that:<\/p>\n<p><strong>\u201cMy description (in the Foreword) of Alite&#8217;s testimony at Gotti Jr.&#8217;s fourth trial &#8212; particularly the account on pages XXIV-XXV of how Alite reacted so violently to an electrician who worked on his property, will give you some sense of what he&#8217;s capable of.\u00a0<\/strong><\/p>\n<p><strong>\u201cOn both direct examination and cross Alite proudly boasted of how he&#8217;d found this electrician sleeping in his bed and reacted by &#8220;piping&#8221; him, stripping him naked, throwing him into a pond on his property, shooting at him and leaving him tied up in his unheated garage in the middle of winter while he -Alite &#8211; went to dinner.<\/strong><\/p>\n<p><strong>\u201cI&#8217;m not a psychiatrist, but I&#8217;d say that John Alite exhibits the benchmark traits of a narcissistic sociopath. He has a grandiose vision of himself and \u00a0reacts strongly and violently to any criticism.<\/strong><\/p>\n<p><strong>\u201cAs I told you, I&#8217;ve covered law enforcement and organized crime for many years and given Alite&#8217;s violent and murderous background, I wanted officials in the Justice Department, who were responsible for his early release, to understand his capacity to make threats &#8212; particularly to a journalist.\u201d<\/strong><\/p>\n<p>That led to a brief investigation of the letter by the FBI\u2019s L.A. field office and on August 10<sup>th<\/sup> SA Aquirre responded with an email<a title=\"Attachment J\" href=\"http:\/\/peterlance.com\/Attach_J_FBI_LA_to_PL.pdf\"><strong> (Attachment J)<\/strong><\/a> in which he stated that while federal prosecutors didn\u2019t find the \u201cJerk off\u201d email actionable, a record of my complaint was created and sent to the files.<\/p>\n<p>He also gave me the phone numbers of several U.S. Probation Office officials because\u00a0 I\u2019d told him I wanted to contact Mr. Alite\u2019s probation officers and relay my complaint to them regarding new evidence I\u2019d found that he was violating your Judgement.<\/p>\n<p>After, Ms. Tashika Curtis in the Tampa (DOP) office refused to even confirm if Mr. Alite was still subject to your sentencing order, I called your chambers and Ms. Saylor confirmed for me, that he was still under Supervised Release.<\/p>\n<p>I finally located Richard Antonison, Duty Officer at Mr. Alite\u2019s probation office in Camden, New Jersey near his home in Cherry Hill. I sent him the evidence I\u2019d uncovered of Mr. Alites\u2019s repeated meetings with ex-O.C. figures and his increasing cyber threats. <a title=\"Attachment K\" href=\"http:\/\/peterlance.com\/Attach_K_PL_to_R_Antonison_FBI_AUSA_J_Trezevant_8_12_15.pdf\"><strong>(Attachment K).<\/strong> <\/a><span style=\"text-decoration: underline;\"><br \/>\n<\/span><br \/>\n<strong>I URGE YOU TO READ THAT EMAIL<\/strong><\/p>\n<p>Because it contains a number of pictures from John Alite\u2019s own Twitter and Facebook pages in which he documents his recent meetings with ex-Mafia associates in defiance of your Supervised Release order.\u00a0Of particular concern are his multiple appearances at Long Island bars and night clubs with Pasquale \u201cPatsy\u201d Andriano. See this excerpt from my email to which Mr. Antonison never responded.<\/p>\n<p><strong>\u201cThe son of a murderous Genovese member whom Alite calls his &#8220;cousin&#8221; in &#8220;Gotti&#8217;s Rules,&#8221; Andriano was the confessed shooter in the murder of John Gebert, whom he killed on July 12th, 1996 at the age of 19.\u00a0<\/strong><\/p>\n<p><strong>\u201cAndriano, as you&#8217;ll see from the attached <a title=\"SDNY Memo\" href=\"http:\/\/ca7.fd.org\/Indiana_Southern\/Documents\/Jasper-%20Rule%2029%20Motion.pdf\">SD<span style=\"text-decoration: underline;\">NY<\/span><span style=\"text-decoration: underline;\">\u00a0MEMORANDUM<\/span><\/a>\u00a0from the prosecution of Gambino killer John Burke was a government witness (CW) in that trial &#8212; and, like Alite was released from prison after his cooperation.<\/strong><strong>\u00a0<\/strong><\/p>\n<p><strong>\u201cIn fact, Andriano was originally indicted with Alite in the alleged Gambino-related murder\/racketeering prosecution in Tampa of <a title=\"Gainesevill.com Trucchio\" href=\"http:\/\/www.gainesville.com\/article\/20041201\/WIRE\/212010340\">Ronald J. &#8220;One Arm&#8221; Trucchio.<\/a> This was the case in which Judge Bucklew sentenced Alite after his plea.<\/strong><\/p>\n<p><strong>\u201cBy the way, when Andriano killed Gebert at Frankie &amp; Johnny&#8217;s bar in Queens, as he hid under a pool table, an innocent bystander was shot.<\/strong><\/p>\n<p><strong>\u201cBelow you&#8217;ll see multiple recent pictures from Alite&#8217;s Facebook account of him with Andriano, including them hanging out with Alite&#8217;s sons at an unidentified beach resort and an upscale Long Island nightclub.<\/strong><\/p>\n<p><strong>\u201cUnderstand that Andriano isn&#8217;t just some mob associate, he&#8217;s the convicted murderer of Gebert, one of the main counts in &#8220;Gotti Jr. IV&#8221; and it&#8217;s clear that John Alite is regularly crossing state lines to party with him.\u201d<\/strong><\/p>\n<p><a href=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Screen-Shot-2015-10-21-at-9.07.41-PM.png\"><img loading=\"lazy\" class=\" wp-image-7770 alignleft\" title=\"Screen Shot 2015-10-21 at 9.07.41 PM\" src=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Screen-Shot-2015-10-21-at-9.07.41-PM.png\" alt=\"\" width=\"493\" height=\"180\" srcset=\"https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Screen-Shot-2015-10-21-at-9.07.41-PM.png 548w, https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Screen-Shot-2015-10-21-at-9.07.41-PM-300x109.png 300w\" sizes=\"(max-width: 493px) 100vw, 493px\" \/><\/a><\/p>\n<p><strong>WHY I BELIEVE YOU WERE MISLED BY FEDERAL PROSECUTORS<\/strong><\/p>\n<p>As I continued to research Mr. Alite\u2019s case, while many documents are under seal, what I found on the public record has caused me to conclude that you may have been misled by Mr. Trezevant and former AUSA Roger Burlingame, both of whom opined to you about Mr. Alite\u2019s alleged \u201csubstantial assistance\u201d to the DOJ, in various 5K.1 motions and letters urging you to grant that 20 month reduction.<\/p>\n<p>Because I believe your Honor to be a respected jurist who enforces the law, I wanted you to see this evidence which raises serious questions about the viability of the Supervised Release program, managed by the DOP.<\/p>\n<p><strong>REVIEWING THE RECORD ON YOUR SENTENCING.<\/strong><br \/>\nIn a <em>New York Daily News <\/em>story April 27<sup>th<\/sup>, 2011 covering your initial 100 month sentence Mr. Burlingame (now in private practice in London) reportedly wrote to you that \u201cJohn Alite provided information that materially contributed to the conviction of numerous members and associates of the Gambino organized crime family.\u201d<a title=\"Attachment L\" href=\"http:\/\/www.nydailynews.com\/life-style\/health\/john-junior-gotti-rat-buddy-john-alite-10-year-prison-sentence-article-1.112949\"><strong> (Attachment L).<\/strong> <\/a><\/p>\n<p>Note his use of the words \u201cmembers\u201d and \u201cconviction.\u201d<\/p>\n<p>In a Motion to partially unseal the sentencing memos submitted by the government on behalf of defendant\u2019s Alite and Malone filed on August 23<sup>rd<\/sup>, 2011, four (4) months after your initial 120 month sentence, Mr. Trezevant writes that \u201cIt is currently planned by the government that Alite and Malone will be listed, and may testify as witnesses for the government in <span style=\"text-decoration: underline;\">U.S. vs. John Burke and David D\u2019Arpino<\/span>. <a title=\"Attachment M\" href=\"http:\/\/peterlance.com\/Attach_M_Motion_to_Unseal_8_23_11.pdf\"><strong>(Attachment M).\u00a0<\/strong><\/a><\/p>\n<p>In a Second Motion Mr. Trezevant went so far as to assure your Honor that \u201cAlite\u2019s substantial assistance involved an extensive series of debriefings \u2026 during which Alite provided details about his <strong>powerful role<\/strong> as an associate of the Gambino Crime Family dating back to the 1980\u2019s.\u201d (emphasis added).\u00a0Later in that same Motion dated January 9<sup>th<\/sup> 2012 he writes, \u201dAlite participated in an extensive series of proffer sessions and provided truthful, substantial information used to indict more than thirty <strong>members<\/strong> and associates of the Gambino Crime Family. (emphasis added). <a title=\"Attach N\" href=\"http:\/\/peterlance.com\/Attach_N_Second_Motion_to_Unseal_1_9_12.pdf\"><strong>(Attachment N).<\/strong><\/a><\/p>\n<p>And Mr. Trezvant goes so far as to write that following his transport from Tampa \u201cMr. Alite \u2026 continued to provide substantial assistance to the Southern and Eastern District of New York in the following cases:<\/p>\n<p>1. U.S. vs. Joseph Corozzo et. al.<br \/>\n<strong>2. U.S. vs. John A. Burke et al.<br \/>\n<\/strong>3. U.S. vs. Peter Plaia.\u201d (emphasis added)<\/p>\n<p><strong>EXAMINING THE TRUTH IN THOSE 5K.1 MOTIONS<\/strong><\/p>\n<p>If you read my Foreword your Honor, you\u2019ll see that John Alite, aka John Aletto, aka Johnny Corvette, never had a \u201cpowerful role\u201d in the Gambino Family.<\/p>\n<p>Given the pecking order of Cosa Nostra, as a non-Italian (Albanian-American) he was a low level associate who was four steps removed from Gotti Jr. In order to do any business, he had to communicate with an Italian-American associate who talked to a \u201cmade\u201d Member (or soldier) who communicated with a Capo (captain) who then interacted with a reputed underboss like Gotti Jr.<\/p>\n<p>In blistering cross examination during Mr. Gotti\u2019s fourth trial by defense attorney Charles Carnesi, John Alite was repeatedly caught in lies when he swore under oath that Mr. Gotti had directed him to commit murders.<a href=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.25.36-PM.png\"><img loading=\"lazy\" class=\"alignright wp-image-7805\" title=\"Screen Shot 2015-10-21 at 11.25.36 PM\" src=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.25.36-PM.png\" alt=\"\" width=\"314\" height=\"224\" srcset=\"https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.25.36-PM.png 485w, https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.25.36-PM-300x214.png 300w\" sizes=\"(max-width: 314px) 100vw, 314px\" \/><\/a><\/p>\n<p>After the jury hung, veteran A.P. reporter Tom Hays filed a story in which he wrote that the jurors were unanimous that Mr. Alite was the \u201cleast credible\u201d of all the witnesses who took the stand for either the prosecution or the defense. <a title=\"Attach O\" href=\"http:\/\/www.huffingtonpost.com\/2009\/12\/01\/gotti-mistrial-junior-got_n_375769.html\"><strong>(Attachment O).<\/strong><\/a><\/p>\n<p>\u201cThey were unanimous on one point,\u201d wrote Hays \u201cThe government\u2019s star cooperator, admitted mob enforcer and former Gotti Jr. friend John Alite bombed on the witness stand.\u201d<\/p>\n<p>And apart from a few dozen low-level associates and members of Mr. Alite\u2019s crew who \u201cflipped\u201d once he\u2019d copped a plea, what about the allegations by Mr. Burlingame that John Alite helped with the \u201cconviction\u201d of \u201cmembers\u2026 of the Gambino Organized Crime Family?\u201d<\/p>\n<p>First, the juries were hung in the only two proceedings in which Mr. Alite testified against, \u201cmade\u201d members. Mr. Gotti\u2019s aforementioned fourth trial in 2009 and (earlier that same year) the trial of Gambino killer Charles Carneglia \u2013 who was convicted, but on the single count for which Mr. Alite testified \u2013 the murder of Court Office Albert Gelb \u2013 the jury was hung.<\/p>\n<p>See the <em>New York Daily News<\/em> coverage of that trial on Sept. 17<sup>th<\/sup>, 2011. <strong><a title=\"Attach P\" href=\"http:\/\/www.nydailynews.com\/news\/crime\/gambino-soldier-charles-carneglia-hitman-john-gotti-sentenced-life-prison-article-1.387632\">(Attachment P).<\/a>\u00a0<\/strong>The lead prosecutor was <strong>Roger Burlingame<\/strong> who had opined to you about Mr. Alite\u2019s \u201csubstantial assistance,\u201d but the jury deadlocked on the Gelb count.<\/p>\n<p><strong>THE FEDS NEVER AGAIN USED JOHN ALITE AS A CW<\/strong><\/p>\n<p>As to Mr. Trezevant\u2019s prediction to you that Mr. Alite would testify for Team Fed in the John Burke trial, they ended up keeping him off the stand.<\/p>\n<p>See<a title=\"Attach Q\" href=\"http:\/\/www.nydailynews.com\/new-york\/gambino-associate-life-gundown-article-1.1247690\"><strong> (Attachment Q)<\/strong><\/a> <em>the New York Daily News<\/em> story from January 25<sup>th<\/sup>, 2013 reporting that \u201cThe Feds pulled out the rug on Gambino turncoat John Alite\u2019s courtroom confrontation.\u201d<\/p>\n<p>It\u2019s one thing, your Honor, for various AUSA\u2019s bent on the conviction of a high profile target like Gotti Jr. to try and deceive a jury and turn a low-level Mafia wannabe like John Alite into a latter-day \u201cSammy The Bull\u201d Gravano. But to get 20 months shaved off his sentence, releasing this admitted multiple murderer out into the world by deceiving a federal judge is something else.<\/p>\n<p>Since some of the sentencing-related documents in Mr. Alite\u2019s case file on Pacer are under seal, you are in the best position to go back and vet the quality of John Alite\u2019s alleged \u201csubstantial assistance.\u201d<\/p>\n<p><strong>WHY DOES THIS MATTER?<\/strong><\/p>\n<p>Take a look at the detailed email I sent to Mr. Alite on August 12<sup>th<\/sup>\u00a0 in which I called on him politely and civilly to demonstrate how he\u2019s not violating your Supervised Release order with impunity by making trips outside NJ to Florida, Ohio, New York, Pennsylvania, Delaware and New York <strong><a title=\"Attach R\" href=\"http:\/\/peterlance.com\/Attach_R_PL_to_J_Alite_8_12_15.pdf\">(Attachment R)<\/a>. <\/strong><\/p>\n<p>I also asked him<strong>\u00a0<\/strong>to justify his claim that he\u2019d spent more than 20 years in prison (as chronicled by Ms. Neuhoff in Ohio) when, per your order (with time served) he did far less, actually getting out in the Spring of 2012 (according to <em>Gotti\u2019s Rules<\/em>).<\/p>\n<p>As I wrote in my email to him, despite his puffery and boasting, John Alite is \u201ca hyper-violent criminal who pled guilty to (his) involvement in two homicides, four murder conspiracies, at least eight shootings and two attempted shootings, not to mention a series of armed home invasions in New York, New Jersey, Pennsylvania and Florida.\u201d<\/p>\n<p>I also noted that his torture of the electrician which he boasted about on both direct and cross during \u201cGotti IV\u201d was the \u201ckind of behavior one would expect from ISIS or The Taliban, not a low-level Mafia associate.<\/p>\n<p><strong>THE LACK OF GRAPHIC EVIDENCE<\/strong><\/p>\n<p>Finally, I noted for Mr. Alite that \u201cone of the most revealing discoveries in <em>Gotti\u2019s Rules<\/em> is how, despite claiming that late in his Mafia career Gotti Jr. personally ordered him to \u201cdo hits,\u201d the only pictures he has in the book of the two of them together are from their early 20\u2019s, long before, as Gotti Jr. insists, he \u201cchased \u201d Mr. Alite out of New York.<\/p>\n<p><a href=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.34.39-PM.png\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-7813\" title=\"Screen Shot 2015-10-21 at 11.34.39 PM\" src=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.34.39-PM.png\" alt=\"\" width=\"182\" height=\"195\" \/><\/a>In that August 12<sup>th<\/sup> email, I asked Mr. Alite, \u201cHow was it John, if you were his\u00a0 \u00a0\u2018baby sitter\u2019 and killed people on his direct orders, that years later, during the trial,\u00a0the Feds never produced <span style=\"text-decoration: underline;\">a single surveillance photo, video or audio recording<\/span> of the two of you together (at the time of the crimes in the indictment) despite the fact that Gotti Jr. was under almost constant FBI surveillance for years?\u201d<\/p>\n<p>I also noted how Mr. Alite had resorted to international cyber-bullying.<\/p>\n<p>\u201cIn retaliation for criticism of you by a British woman named Janine Battey who uses the screen name Janine Finch 69, you posted a picture of her showing Mrs. Finch and her husband with this comment:<\/p>\n<p><strong>&#8220;Hi everyone (sic) This is Janine finch69 the women who we need to poster all over how not to act. This is your typical bully coward who we want our children to be nothing like. She is (sic) crude individual. Next month when I come to the UK I will pass her address out for you all to know her. Please understand this is someone that hides under a different name and is the worse (sic) example of a mother adult and human being.&#8221;\u00a0<a href=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Janine-Batty-Alite-threat1.png\"><img loading=\"lazy\" class=\"alignright wp-image-7772\" title=\"Janine Batty Alite threat\" src=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Janine-Batty-Alite-threat1.png\" alt=\"\" width=\"464\" height=\"376\" srcset=\"https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Janine-Batty-Alite-threat1.png 725w, https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2015\/10\/Janine-Batty-Alite-threat1-300x243.png 300w\" sizes=\"(max-width: 464px) 100vw, 464px\" \/><\/a><br \/>\n<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Then I asked him,<strong> \u201c<\/strong>What kind of man, who has recast himself as a \u201cmotivational speaker\u201d to help children avoid lives of crime, would resort to that kind of trans-Atlantic cyber-bullying? Having covered dozens of criminals in a 40+ year career John and having a pretty good sense of a narcissistic sociopath when I see one, it\u2019s that kind of threat that caused me to send your \u201cJerk off\u201d email to the Feds, encouraging them to rein you in.\u201d<\/p>\n<p><strong> GETTING A SURROGATE TO RESPOND<\/strong><\/p>\n<p>Apparently lacking the courage to address my questions directly, Mr. Alite proceeded to ask a local Pennsylvania cable TV host named John Ricciutti to respond. I would like to respond to your mailing regarding John Alite.<\/p>\n<p>John Ricciutti,\u00a0<em>producer\u00a0<\/em>Radnor Studio 21 Wayne Pa., 19087 610-716-9288<\/p>\n<p>When I confirmed my email address and never heard back from him, I sent an email to Mr. Ricciutti Sept. 7th\u00a0<a title=\"Attach S\" href=\"http:\/\/peterlance.com\/Attach_S_PL_to_J_Ricciutti_9_1_15.pdf\"><strong>\u00a0(Attachment S)<\/strong><\/a> asking why, during his interview of Mr. Alite on June 19<sup>th<\/sup> he simply accepted, without question, that this confessed murderer and torturer was now reformed.<\/p>\n<p>He responded to me September 2<sup>nd<\/sup>, 2015 by saying, effectively, that he\u2019d decided not to speak for Mr. Alite.<\/p>\n<p>&#8220;<strong>Mr. Lance, upon further reflection and review of your lengthy email again, I choose not to respond. Our programs are informational, educational and entertaining. The subject matter is directed by the interviewee and we offer no opinion as to veracity\u00a0 as that is left to the discretion of our viewers.\u00a0John Ricciutti\u00a0<\/strong><\/p>\n<p>But shortly thereafter Mr. Ricciutti made a comment on Mr. Alite\u2019s Facebook page calling me a \u201czealot,\u201d although mistakenly from Ohio, to which John Alite jumped in with the kind of veiled threat he\u2019s now infamous for, calling me a \u201cstalker.\u201d\u00a0<a title=\"Attach T\" href=\"http:\/\/peterlance.com\/Attach_T_Alite_Facebook_Ricciuttiti_Lance_zealot_stalk_9_2_15.pdf\"><strong>(Attachment T).<\/strong> <\/a><\/p>\n<p>He also suggested that Ricciutti invite me on his program so I could \u201csit next\u201d to him. Like his invitation for me to confront him in Little Italy <a title=\"Attach A\" href=\"Attach_A_Alite_email_8_4_15.pdf\"><strong>(Attachment A)<\/strong> <\/a>Alite seems bent on provoking a man a mano confrontation.<\/p>\n<p><strong>WHY YOU SHOULD BE CONCERNED<\/strong><\/p>\n<p>Assuming that you unleashed John Alite on an unsuspecting public 20 months early because you believed AUSA\u2019s Trezevant and Burlingame, how will you feel, your Honor, if this ticking time bomb goes off?<\/p>\n<p>Alite\u2019s latest \u201cstalker\u201d allegation, his refusal to apologize or back down from his \u201cheroin addict\u201d and other defamatory allegations and his months\u2019 long used of social media to promote himself as a Gravano-level mob figure, coupled with his willingness to lash out at a journalist like me or a critic like poor Ms. Finch in England, have all the earmarks of the behavior of a narcissistic sociopath:<\/p>\n<p>He has a constant need for attention and admiration, a grandiose vision of himself and a tendency to act negatively &#8211; sometimes violently &#8211; when criticized or challenged.<\/p>\n<p>As noted in the beginning of this letter, he\u2019s already gone on record as predicting that now that he\u2019s out, he could kill again. See <a title=\"Attach U\" href=\"http:\/\/peterlance.com\/Attach_U_Capeci_Alite_could_kill_again_5_7_15.pdf\"><strong>(Attachment U)<\/strong> <\/a>a May 7<sup>th<\/sup>, 2015 interview John Alite gave to celebrated New York Mafia reporter Jerry Capeci for his<em> Gangland News <\/em>column.<\/p>\n<p>Claiming that Gotti Jr. allowed his son (John A. Gotti Jr.) to \u201ccyber-stalk\u201d him, \u00a0Mr. Capeci quoted Mr. Alite as saying this about Mr. Gotti:<\/p>\n<p>\u201cHow does he know that I\u2019m not going to be a killer again? He\u2019s ratcheting him up, putting a battery pack in him, getting him worked up. If he runs into me God forbid, and he comes after me, and I kill this kid because of this nonsense he\u2019s telling him, what does he do then? What\u2019s wrong with him?\u201d\u00a0<a href=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.50.32-PM.png\"><img loading=\"lazy\" class=\"alignright wp-image-7818\" title=\"Screen Shot 2015-10-21 at 11.50.32 PM\" src=\"http:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.50.32-PM.png\" alt=\"\" width=\"476\" height=\"256\" srcset=\"https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.50.32-PM.png 735w, https:\/\/peterlance.com\/wordpress\/wp-content\/uploads\/2014\/06\/Screen-Shot-2015-10-21-at-11.50.32-PM-300x160.png 300w\" sizes=\"(max-width: 476px) 100vw, 476px\" \/><\/a><\/p>\n<p><strong>PREVENTING ANOTHER \u00a0INCIDENT LIKE THE ONE WITH JACK HENRY ABBOTT<br \/>\n<\/strong><br \/>\nYour Honor, you live in Tampa but I\u2019m sure you\u2019re aware of the most notorious example of an early release gone-wrong after the infamous Willie Horton incident.<\/p>\n<p><a title=\"Attach V\" href=\"http:\/\/cityroom.blogs.nytimes.com\/2007\/11\/12\/mailer-and-the-murderer\/\"><strong>Attachment V<\/strong><\/a> is an account by Sewell Chan writing in <em>The New York Times<\/em> on November 12<sup>th<\/sup>, 2007. In the piece he reports on how the celebrated author Norman Mailer had championed the parole of convicted killer Jack Henry Abbott in 1981 after Abbott had written (what became) a critically acclaimed prison memoir, <em>In The Belly of The Beast. <\/em>Mailer even agreed to hire Abbott as a research assistant and got him a book deal with Random House.<\/p>\n<p>But just a few weeks later in an Upper East Side caf\u00e9, Abbott snapped during an argument with a young 22 year-old waiter (Richard Adan) and stabbed him to death. He later committed suicide after his return to prison.<\/p>\n<p>The Abbott story remains a testament to what can happen when a dangerous, hyper-violent career criminal is returned to society and given a bully pulpit.<\/p>\n<p><strong>MY REQUEST TO YOU \u2013 REPORTER TO JUDGE<\/strong><\/p>\n<p>Your Honor, if not out of concern for the safety of the public; if not out of concern that you might have been misled by Federal prosecutors bent on \u201cgetting\u201d Gotti Jr. who utterly overstated John Alite\u2019s value as a cooperating witness, then I ask you to take this letter seriously if the Supervised Release program is to have any meaning.<\/p>\n<p>In light of the incredibly loose leash that the U.S. Office of Probation seems to have on John Alite, I interviewed several former federal inmates (including John A. Gotti) about the nature of their release.<\/p>\n<p>This is what \u201cJunior\u201d told me:<\/p>\n<p>\u201cMy parole was so strict that if I was in a restaurant with my family and anybody from the old life walked in, not only could I not speak to them or even make eye contact, but I had to immediately call my probation officer.<\/p>\n<p>\u201cThe idea that Alite is socializing with Pasty Andriano at a Long Island night club where booze is sold and drugs are used \u2013 the very guy who did the John Gebert murder at Alite\u2019s behest \u2013 is absolutely unbelievable. That he\u2019s running in and out of Jersey and hanging with associates and his former confederates, apparently with the advice and consent of the Feds, makes a mockery of the term \u2018Supervised\u2019 Release.\u201d<\/p>\n<p>So there it is, your Honor. In my opinion, having covered law enforcement at the local, state and federal level for more than thirty years, if any parolee deserves to be \u201cviolated\u201d and sent back to prison, it\u2019s John E.
